A fascinating case about celebrity ownership of their image.
This is a landmark victory, but will it open up the floodgates? It's unusual that all these factors would come into play for for other artists into the future.
Rhianna had recently worked with Arcadia owned TopShop (legitimately), and then used that as a smokescreen to create unlicenced T’s with her face on it - that were deemed to be ‘passing off’ because they were seemingly authorised…
And the photo’s were’nt theirs to use either.
The BBC’s legal correspondent Clive Coleman said this was the first reported English case of a celebrity claimant successfully relying on passing off to claim compensation for the unauthorised use of their personal image on merchandise.
They must have sold quite a few of them too, for a payout like that!
